Terms of Service

These Terms of Service ("Terms") govern your access to and use of Flynn OS, a coaching intelligence platform operated by The Fit Physician ("we", "us", "our"). By creating an account or using the Platform, you agree to be bound by these Terms.

1. Acceptable Use

Flynn OS is designed for personal trainers, coaches, and fitness professionals to manage their coaching businesses. You agree to use the Platform only for legitimate coaching and training purposes. You may not:

• Use the Platform for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Platform or its systems
• Interfere with or disrupt the integrity or performance of the Platform
• Upload or transmit malicious code, viruses, or harmful content
• Use the Platform to store or distribute content that is defamatory, obscene, or infringing
• Resell, sublicense, or redistribute access to the Platform without our written consent

2. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You agree to:

• Provide accurate and complete information when creating your account
• Keep your login credentials confidential and not share them with others
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

You must be at least 18 years old to create an account on Flynn OS.

3. Subscription and Billing

Flynn OS offers paid subscription plans billed on a monthly or annual basis. By subscribing, you agree to the following:

• All payments are processed securely through Stripe
• Subscriptions automatically renew at the end of each billing period unless cancelled
• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period — you retain access until then
• Refunds are handled on a case-by-case basis at our discretion
• We reserve the right to change pricing with 30 days notice to existing subscribers

4. Data Ownership

You retain full ownership of all content and data you create or upload to Flynn OS, including client information, workout programs, templates, and business content. By using the Platform, you grant us a limited license to host, store, display, and transmit your content solely for the purpose of providing and improving the service.

We do not claim ownership of your data. If you cancel your account, you may request an export of your data before deletion.

5. Limitation of Liability

To the maximum extent permitted by law, The Fit Physician and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. This includes, but is not limited to:

• Loss of data, revenue, or business opportunities
• Errors, interruptions, or delays in service
• Actions taken based on information provided through the Platform
• Unauthorized access to or alteration of your data

Our total liability for any claims arising from these Terms or your use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim.

6. Service Availability

We strive to keep Flynn OS available and reliable, but we provide the service on a best-effort basis. We do not guarantee any specific uptime or service level agreement (SLA). We may occasionally need to perform maintenance, updates, or experience outages that temporarily affect availability.

We are not liable for any downtime, data loss, or disruption caused by factors beyond our reasonable control.

7. Beta Status

Flynn OS is currently in beta. This means:

• Features may change, be added, or be removed without notice
• You may encounter bugs or unexpected behavior
• We welcome and encourage feedback to help improve the Platform
• Beta pricing and features are subject to change upon general release

By using the Platform during beta, you acknowledge and accept these conditions.

8. Termination

Either party may terminate this agreement at any time:

• By you: Cancel your subscription through your account settings or by contacting us
• By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or for any other reason with reasonable notice

Upon termination, your right to use the Platform ceases immediately. We will retain your data for 30 days following termination, during which you may request an export. After 30 days, your data will be permanently deleted.

9. Modifications to Terms

We may update these Terms from time to time. When we make significant changes, we will notify you via email or through a notice on the Platform. Continued use of Flynn OS after changes take effect constitutes your acceptance of the revised Terms.

If you do not agree with the updated Terms, you may cancel your account before the changes take effect.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Platform shall be resolved through good-faith negotiation before pursuing formal proceedings.
